These Terms and Conditions govern your use of yoursmileassociate.com (the “Site”) and the Smile Associates Patient Messaging SMS text messaging program operated by J. Delgado Dental, DDS, P.A. d/b/a Smile Associates (“Smile Associates,” “we,” “us,” or “our”). By using the Site or opting in to our text messages, you agree to these terms.
1. SMS Program Description and Message Use Cases
Smile Associates sends text messages to patients and prospective patients who opt in through the contact form on our Site. There are two optional message types; you may opt in to either, both, or neither:
- Non-marketing (informational) messages: appointment reminders and confirmations, scheduling updates, and replies to your inquiries.
- Marketing (promotional) messages: special offers, promotions, and news about our practice and services.
Consent is not a condition of purchase or of receiving care.
2. How to Opt Out (Text STOP)
You can cancel the SMS service at any time. Text STOP to the number that messaged you. After you send STOP, we will reply with one final message confirming you have been unsubscribed, and you will no longer receive text messages from us. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT. To rejoin, opt in again on our Site or text START.

4. Message Frequency and Message and Data Rates
Message frequency varies depending on your appointments and interactions with us. Message and data rates may apply for any messages sent to you from us and to us from you, according to your wireless plan. Contact your wireless provider for questions about your plan.
5. Carrier Liability Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery depends on your wireless carrier and device and is not guaranteed.
6. Age Restriction (18+)
You must be 18 years of age or older to opt in to our SMS program and use the Site. By opting in, you confirm that you are at least 18 and are the account holder or authorized user of the mobile number provided.
7. Privacy Policy
Your information is handled according to our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
8. No Medical Advice; Emergencies
Content on the Site and in our messages is general information, not a substitute for professional dental or medical advice. Do not use the Site, forms, or texts for urgent needs. In a medical emergency, call 911.
9. Use of the Site and Limitation of Liability
You agree to use the Site only for lawful purposes. Site content belongs to J. Delgado Dental, DDS, P.A. or its licensors. The Site and SMS program are provided “as is,” and to the fullest extent permitted by law we are not liable for indirect, incidental, or consequential damages arising from their use.
10. Governing Law and Changes
These terms are governed by the laws of the State of Florida. We may update them by posting a new version on this page with a new effective date.
